Authorization
Authorization, i.e. the appointment of an authorized representative for EPR, is an obligation of every foreign manufacturer that is not based in Poland and sells equipment to Polish consumers by means of distance communication. The authorized representative assumes responsibility for ensuring compliance of the foreign manufacturer’s operations with the Polish EPR regulations.

The obligation to appoint an authorized representative for EPR in Poland applies to foreign entrepreneurs who do not have their registered office (registered address) in the country and sell electrical and electronic equipment to Polish customers via:

Own online stores, TV, telephones, e-mails, catalogs, forms, etc.

Marketplaces, e.g. Allegro, eBay, Amazon, Zalando, Etsy.
For foreign manufacturers introducing packaging, accumulators and batteries to the Polish market and selling equipment to other categories of recipients, it is not mandatory to have an authorized representative . In each of these cases, however, we recommend appointing an EPR representative in Poland – this will help you avoid problems with the implementation of obligations and severe financial penalties for failure to comply with them.

Waste management for introduced packaging, batteries and equipment
Companies introducing packaging, packaged products, batteries and equipment to the Polish market must ensure the recovery and disposal of waste generated from them. The authorization fee includes:
- organization of the collection and processing of waste from the introduced products and packaging,
- achieving collection, recycling and recovery targets,
- concluding a contract with a recycler (does not apply to packaging),
- conducting public educational campaigns,
- cyclical reporting of the weights of introduced packaging, equipment and batteries,
- monitoring changes in EPR regulations for your company.
We will take over your obligation to recover, recycle, dispose of and prepare for re-use in relation to:
- packaging and packaged products,
- electrical and electronic equipment,
- batteries and accumulators.
The cost of the service depends on the types of products introduced (packaging, batteries and accumulators, as well as electrical and electronic equipment) and their weight. A higher quantity means higher costs for waste collection, sorting and processing.
The registration number is necessary for the proper fulfillment of the obligations resulting from the EPR.

How to delegate EPR responsibilities in Poland to Interzero?

Registration:

Service selection:
Select the types of products you are placing/selling on the Polish market and indicate for which of them you need an authorized representative.

Contract preparation:
Insert the quantity of products you are launching, generate your contract and read its contents.

Signature:
Sign the contract and upload it to the portal by following the instructions you received. If you have chosen the BDO registration service, please sign and send us the generated power of attorney as well.

Confirmation:
Once we receive your contract, we will immediately sign it and send it back to you.

Questions about the authorized representative
Under Polish law, an authorized EPR representative is a representative of a foreign entrepreneur responsible for performing obligations arising from national regulations on extended producer responsibility within the territory of Poland. Depending on the content of the contract concluded between the manufacturer and the authorized representative, these obligations may apply to different categories of goods from this manufacturer (electrical and electronic equipment).
An authorized representative for EPR in Poland must be appointed by any manufacturer of electrical and electronic equipment that is not based in Polish and sells equipment to Polish households or users other than households by means of distance communication directly
Other manufacturers who place electrical and electronic equipment on the market have the right to appoint an authorized EPR representative in Poland, who will relieve them of the time-consuming obligations of the introducer
No, it is not. According to Polish regulations, foreign entrepreneurs who do not sell equipment directly to households by means of distance communication do not need to have an authorized EPR representative in Poland. However, manufacturers who place equipment on the market may voluntarily appoint a local authorized representative who will take full responsibility for the implementation of their legal obligations under the Polish EPR regulations.
Yes. The Polish EPR regulations do not provide for any quantitative exemptions. This means that the obligation to appoint an authorized representative applies to all manufacturers not based in Polish who sell at least 1 piece of equipment to Polish households using means of distance communication (e.g. online store, advertisement on a sales platform, etc.).
Your EPR company’s authorized representative in Poland can be:
- natural person
- an organizational unit without legal personality,
- legal person
which has an address or registered office in the territory of Polish, respectively.
With regard to electrical and electronic equipment, an electrical and electronic equipment recovery organization such as Interzero can also be an authorized representative.
No. The Polish EPR regulations do not provide for exemptions for micro- and small enterprises. This means that every foreign company, regardless of the size and quantity of equipment introduced, which sells this equipment directly to Polish households by means of distance communication, is obliged to have an authorized representative in Poland.

The manufacturer’s authorised representative for EPR in Poland performs the duties of an introducer in relation to:
- electrical and electronic equipment placed on the market by the manufacturer.
The catalogue of obligations of the person placing the equipment on the market includes:
- organization and financing of the collection and processing of waste electrical and electronic equipment,
- achieving the statutory objectives for the collection, recovery, preparation for re-use and recycling of WEEE,
- conclusion of an agreement with a recycler dealing with WEEE processing,
- conducting public educational campaigns (along with the annual settlement of this obligation).
Branches and subsidiaries of foreign companies are usually not registered in Polish business registers (CEIDG, KRS), so they do not have Polish registered addresses. If your branch also does not have a registered address in Poland, you are required to appoint an authorized EPR representative. The exception is when your company does not sell equipment to Polish individuals (households) by means of distance communication – then the appointment of an authorized representative is voluntary.

Definitions: Who has the obligation and who has the right to appoint an authorized representative?
Within the meaning of the Polish Act of 11 September 2015 on waste electrical and electronic equipment, a manufacturer is any natural or legal person or organizational unit without legal personality, which, regardless of the sales technique used, including by means of distance communication:
- is established in the territory of a Member State other than the Republic of Poland and manufactures equipment under its own name or trademark or places on the market under its own name or trademark in the territory of that Member State equipment designed or manufactured for it,
- has its registered office in the territory of a Member State other than the Republic of Poland and resells equipment manufactured by other entities in the territory of that Member State under its own name or trademark; the reseller is not considered to be a manufacturer if the equipment bears the name or trademark of the entity referred to in point (a) or point 20(a),
- is established in the territory of a Member State other than the Republic of Poland and, in the course of a commercial activity, whether in return for payment or free of charge, supplies equipment for distribution, consumption or use for the first time on the market of that Member State from a non-Member State or from another Member State, or
- has its registered office in the territory of a Member State other than the Republic of Poland or a non-Member State and sells equipment in the territory of the country by means of distance communication directly to households or users other than households
– except that an entity which provides financing on an exclusive basis under or in accordance with a financing agreement, understood as any loan, lease, rental or deferred sale agreement or arrangement, relating to any equipment, regardless of whether the terms of that agreement or arrangement or any additional agreement or additional arrangements provide for the transfer or transfer of ownership of that equipment, unless it is acting as a manufacturer at the same time.
For the manufacturers described in points (a) to (c), the appointment of an authorised representative is voluntary. In the case of entities described in letter d, there is a legal obligation to have an authorized EPR representative in Poland.
Within the meaning of the Polish Act of 11 May 2002 on the obligations of entrepreneurs in the management of certain waste and on the product fee, the following are considered to be manufacturers of single-use plastic products or fishing gear containing plastics:
- a natural person, an organizational unit without legal personality and a legal person residing or having its registered office in the territory of a Member State of the European Union or a country other than the Republic of Poland, which professionally deals with the sale of single-use plastic products or fishing gear containing plastic in the territory of the country, regardless of the sales technique used, including by means of distance contracts within the meaning of Article 2(7) of Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, amending Council Directive 93/13/EEC and Directive 1999/44/EC of the European Parliament and of the Council and repealing Council Directive 85/577/EEC and Directive 97/7/EC of the European Parliament and of the Council (OJ L 2011, p. EU L 304, 22.11.2011, p. 64, as amended. amended),
- a natural person, an organizational unit without legal personality and a legal person residing or established in the territory of the country, which professionally deal with sales in another Member State of the European Union directly to private households or non-private users 3) Amendments to the above-mentioned Directive have been announced in the Official Journal of the European Union.
